$0 NFA Transfers, But What Does That Mean? | OHUB News
Since the signing of the OBBB into law on July 4th, the dust has settled—somewhat. Since then, the GOA has filed the “One Big Beautiful” Lawsuit to challenge the constitutionality of the NFA, now that a tax is no longer applied. More lawsuits are likely to follow, with both the Firearms Policy Coalition and Second Amendment Foundation teasing upcoming suits. But in the meantime (because lawsuits are not quick), what does this mean for gun owners?
Now What?
As mentioned, the OBBB was signed on July 4th, but that’s not when the $0 NFA fee takes effect. The bill’s language states the following:
The amendments made by this section shall
apply to calendar quarters beginning more than 90 days after the date
of the enactment of this Act.
In simple terms, since we are in the third quarter of 2025, the tax reductions will take effect on January 1, 2026. Even with the tax reduction, a Form 4 is still needed. Therefore, a shopper must go through an FFL that has an SOT (or use Silencer Central or Silencer Shop online and work with their network of dealers). So yes, the dreaded paperwork, including fingerprints, a photograph, and a questionnaire, is still required.
My Hesitation
That said, I have a concern. From now until the end of the year, suppressor sales are expected to slow down as people cautiously wait. During this period, manufacturers will likely offer rebates to offset the $200 tax in an effort to attract customers. Meanwhile, this probably means E-form checks will stay quick, with many approvals happening within two weeks and, in some cases, within just a few days. However, after the new year begins, I expect the E-forms system to become overwhelmed as many rush to take advantage of $0 taxes on suppressors, short-barreled rifles and shotguns, and AOWs. This will probably slow approval times. It’s hard to predict exactly, but things could slow down to months rather than weeks, as they are now.
Zooming Out
If you’re considering a suppressor, now could be a good time to buy. Watch for sales and rebates to help cover the $200 tax and benefit from shorter wait times. Keep in mind, the bill only lowers the tax; it doesn’t alter the process of purchasing, so paperwork and a wait are still necessary.
