Anti-Gunners are Trying to RAISE the NFA Tax | OHUB News
Whenever a victory for gun owners happens, a setback often follows. While many are still celebrating the success in the OBB—a reduction of the NFA tax stamp to $0—this has opened another can of worms. Currently, there’s a bill moving through Congress titled “H.R.3944 – Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2026.” Sounds harmless, right?
But It’s About Guns?
While this is essentially a budget bill dealing with military and agency affairs, anti-gun senators took the opportunity to enter Senate Amendment 2973 to H.R.3944. It reads:
(a) Transfer Tax.–Subsection (a) of section 5811 of the
Internal Revenue Code of 1986, as amended by section 70436(a)
of Public Law 119-21, is amended to read as follows:
“(a) Rate.–There shall be levied, collected, and paid on
firearms transferred a tax at the rate of $4,709 for each
firearm transferred.”.
(b) Making Tax.–Section 5821(a) of the Internal Revenue
Code of 1986, as amended by section 70436(b) of Public Law
119-21, is amended–
(1) in paragraph (1), by striking “$200” and inserting
“$4,709”, and
(2) in paragraph (2), by striking “$0” and inserting
“$55”.
(c) Conforming Amendment.–Section 4182(a) of the Internal
Revenue Code of 1986, as amended by section 70436(c) of
Public Law 119-21, is amended by striking the second
sentence.
(d) Effective Date.–The amendments made by this section
shall apply to calendar quarters beginning more than 90 days
after the date of the enactment of Public Law 119-21.
In simple terms, this amendment aims to address 90 years of inflation by increasing the tax stamp fee on certain firearms regulated under the NFA. We went from $200 to $0. Now, a Bill amendment is threatening to raise that to over $4,700 per stamp and effectively killing the market. Just as things were going our way, an attack in the night happened. Hopefully, as more people become aware of this, legal experts will weigh in, and I can update you all further.
Zooming Out
I’d be surprised if this amendment passes. Just as House and Senate Republicans fought for the Second Amendment, I doubt they will let this go through. If anything, it’s frustrating. Congress cannot ban items protected by the Second Amendment; however, it is trying to tax them to levels that would prohibit nearly everyone, much like in the 1930s. Isn’t Congress supposed to represent the people? Hopefully, the “Big Beautiful Lawsuit” and other pending legal actions will render this issue irrelevant.
