SAF Reacts to Reese v. ATF | OHUB News
In recent weeks, I’ve been keeping you updated on the 18-20 handgun ban in Reese v. ATF. Furthermore, the Fifth Circuit recently reversed the Eastern District of Louisiana’s decision and sent the case back to the district court for further judgment. Unfortunately, the District Court took a very narrow stance in its injunction.
What Happened
The District Court, in its injunction, restricted the organizational membership relief to individuals who were members of the plaintiff organizations as of the filing date, November 6, 2020. And who are within the geographical boundaries of the Fifth Circuit (Texas, Mississippi, and Louisiana). Moreover, the District Court also required the plaintiff organizations to produce a list of those affected members within 21 days of judgment. As you can imagine, that has caused outrage amongst the SAF membership and 2A activists.
SAF Response
In short order, the Second Amendment Foundation sought action to prevent such a thing from happening. Executive Director Adam Kraut had this to say:
“Once we read the judge’s order, we took quick and decisive action to ensure our member data will not be supplied to anyone, much less the government. Thankfully, the Department of Justice agreed with our position and has joined in this motion to amend the judgment. However, it should still be made extremely clear, SAF has never – and will never – provide the government a list of our members, and we won’t be strong-armed into turning over the private data of those who support SAF and the Second Amendment.”
Additionally, this case extends beyond just the SAF and its members.. Joining SAF as plaintiffs includes the Firearms Policy Coalition, the Louisiana Shooting Association, and three private citizens.
Zooming Out
The declaration and requirement by SAF and other member organizations to turn over their member rosters is jarring. Executive Vice President Alan Gottlieb shared this sentiment:
“In all my years working in and around the Second Amendment litigation space I have never seen such an egregious order issued by the court. To think we would even consider releasing member information is beyond the pale, and we will fight tooth and nail to protect the privacy of all SAF members. We’re grateful the DOJ agreed to join the motion, and we hope this ends the issue once and for all.”
